Lawsuit accusing Fort Wayne officer of excessive force allowed to proceed

FORT WAYNE, Ind. (WPTA21) – A lawsuit filed against a Fort Wayne police officer by the man he shot during a robbery can move forward, a federal judge has ruled.

Anthony Gant (pictured) first sued the department and three officers after he was shot in the abdomen while robbing a Dollar General store in August 2015. All parties were later removed from that suit, except for the officer who fired the shot that wounded Gant.

Officer Daniel Hartman has said he believed Gant was reaching for a weapon when he shot him. No weapon was ever found on Gant, who later admitted to robbing the store and who is currently serving time in an Indiana prison.

His earliest possible release comes in 2024.

The lawsuit has been reassigned to U.S. District Court Judge Holly A. Brady, who was sworn in to that role in April.
