Court Documents reveal details behind arrest that led to battery charges

FORT WAYNE, Ind. (WPTA21) — We are learning more details about an arrest that resulted in a now-former FWPD officer facing battery charges.

A probable cause affidavit filed in the Allen County Court against Charles Smith reveal information about the DUI arrest that he conducted before facing charges.

ABC21 previously reported the DUI arrest that led to the battery charges happened on March 23.

The court document reveals Smith was arresting Jason Chambers for allegedly driving under the influence. The document states Chambers refused to comply with a breath test and a search warrant for a blood sample.

Smith went to place Chambers in handcuffs when the document states Chambers pulled away. Smith hit Chambers three times while still holding the handcuffs. This resulted in Chambers suffering a cut and swelling to his forehead.

Smith pleaded guilty to a misdemeanor count of battery in the case. He was sentenced to a suspension of 365 days, and was ordered to pay a fine of $25.
